www.plastikphilosophy.com is a website operated by Plastik Philosophy Limited (“Site”) . We are registered in England and Wales under company number 06128847. Our registered office is at 103 Russell Road, London, SW19 1LN.
These Terms and Conditions shall apply to Your use of the Site. By using the Sky Site You agree to be bound by the terms and conditions set out below. If at any time you do not accept the Terms and Conditions, please do not use the Site.
1. Definitions
"You/Your" means You, the user, "We/Us" means Plastik Philosophy Limited. "Site" shall have the meaning as set out above. "Website" means a site on the World Wide Web. ”Merchandise” means the merchandise available for purchase on the Site such as t0shirts and key rings;and “Tracks” means the music either played or available for purchase on the Site.
2. Intellectual Property
2.1 The names, logos, trade marks (whether registered or unregistered), trade names and any service marks, including without limitation, “Plastik Philosophy” and “OBE” (“Trade Marks”) appearing on the Site are the property of PP and may not be used by you in any manner. All other trade marks, trade names or service marks not owned by us that appear on this Site are the property of their respective owners, who may or may not be affiliated with, or connected to, us and are also subject to similar restrictions on use.
2.2 The names, likeness, images and other so called image rights of the DJs and artists that appear on the Site are the proprietary rights of us and/or the respective DJs and artists and may not be used or reproduced by you in any manner without our express written permissions.
2.3 All content included on the Site, such as text, documents, graphics, logos, button icons, images, audio and video, data compilations, together with any material sent to you by us in email or any other form as well as the software used in the Site (“Content” or “Contents”), is our property or our licensors and is protected by copyright and database right laws around the world. The compilation of all Content on the Site is our exclusive property. You may not copy, download, upload, modify, reproduce, transmit, delete, add to, distribute in any way, or otherwise use for any purpose any of the Content except as stated in these Terms and Conditions, or with the prior consent of the owners of the Content.
2.4 You acknowledge that the copyright of all Tracks that are listed on this Site , which can be purchased and downloaded, and/or are played on the Site either belongs to us or a third party and you will not acquire or copy these tracks without purchasing them via the Site or another authorised Website and that you shall report any offer to acquire such tracks for no payment from any third Party or Website and/ or where it is clear that the third party or Website does not have the right to sell those tracks.
3. Purchases
In the event you make any purchases via the Site, you agree to read, understand and fully comply with The Purchase Terms and Conditions.
4. Linking
You may not link to any page of our Site, other than the Site home page, from any website controlled by you without our express written consent. If you link to the Site home page, you may not do so in any manner that would suggest that we are endorsing in any form, is associated with, or approves of you or of your website.
4. Registration
4.1 When you register with us, we will make available for you to purchase digital downloads of sound and video recordings, related digital content and materials, and also purchase Merchandise. Using your secure password and valid e-mail address you may purchase Tracks and Merchandise. Payment will be per purchased Track or Merchandise and will be taken from your credit or debit card or through a PayPal account.
4.2 You must provide accurate and complete registration information and inform us of any changes to that information (including your e-mail address) by altering your details as appropriate or by contacting info@plastikphilosophy.com.
4.2 Registration is for single user only.
4.3 Children under the age of 13 may not register with us. If you are between the ages of 13 and 16 please ensure that you have your parent or guardian’s consent to register.
5. Competitions
With respect to any competitions that we organize, you acknowledge and agree;
No purchase necessary.
Only one entry per person.
All qualifying entrants who answer the question correctly will be placed in a free prize draw.
Winners will be notified within 28 days of the draw taking place.
There is no cash alternative to the prize.
This competition is run by us.
The competition is not open to anyone associated with us or any associated companies.
The judges' decision is final and no correspondence will be entered into.
No responsibility can be accepted for entries which are not properly received due to communications beyond our control.
All prizes are subject availability.
Unless otherwise stated and if applicable to the competition, all transport is the entrant's responsibility.
Your email address and SMS details will not be published on our site, but will allow us to contact the winners of this competition.
By submitting your email address and/or SMS details, you also agree to receive our latest news, offers.
6. Our Rights
6.1 We will endeavour to provide the Site using all reasonable care. To the extent permitted by law, We exclude all implied warranties as to quality, accuracy or fitness and We do not warrant that the material contained in the Site, any of the functions contained in the Site and the server will operate without interruption or delay or will be error free, free of viruses or bugs or is compatible with any other software or material.

8. Indemnity
You agree to fully indemnify us against any claims or legal proceedings arising in connection with your use of the Site which are brought or threatened against us by any other person/company. You will fully indemnify and defend us against all claims, liability, damages, costs and expenses, including legal fees, arising out of a breach of these Terms of Use or any use of the Site by you. You further undertake that in the event that you have any right, claim or action against any other user arising from the use of the Site, you shall pursue such right, claim or action independently of, and without recourse to us.
9.Termination
We shall have the right immediately to terminate Your use of the Site if We determine in Our sole discretion that You have breached these terms and conditions or otherwise been engaged in conduct which We determine in Our sole discretion to be unacceptable.
10. General
10.1 If any of these terms and conditions are determined to be invalid or otherwise unenforceable by reason of the application of any law, such provisions shall be severed and deleted from these terms and conditions and the remainder of these terms and conditions shall continue to have full force and effect.
10.2 These terms and conditions are governed by English law and both You and Us hereby submit to the exclusive jurisdiction of the English courts.
